El propósito que se pretende alcanzar en este artículo, es determinar cuáles limitaciones presenta el tratamiento legislativo del acusado, a ejercer el Derecho a la Defensa en la fase preparatoria del proceso penal cubano. Se centra, especialmente, en su regulación Constitucional de acuerdo con lo establecido en su artículo 59 y en su ordenamiento, en la ley de rito cubana; así como en las limitaciones que presentan los mentados cuerpos legales que colocan, en ocasiones, en un estado de indefensión al imputado o acusado de un delito; análisis que tiene lugar, a partir del estudio teórico y práctico. Primeramente, se realiza un estudio doctrinal del Debido Proceso; sus principios y en especial atención, al Derecho a la Defensa como pilar básico del mismo e inexorablemente unido a este. Seguido se realiza un análisis del mentado derecho, tanto en la Constitución cubana como en la Ley de Procedimiento Penal, partiendo de un estudio crítico de estas normas. Al final, se relacionan, las conclusiones que se derivan del mencionado artículo.
This paper, aimed at determining the limitations existing in the legislative treatment of the accused when practicing their right to present a defense in the preparatory stage of the prosecution process in Cuba, is mainly focused on the constitutional regulations according to what Article 59 and its provisions establish in the Cuban civil procedure law; as well as on the limitations of the legal bodies which sometimes place the imputed or accused of a crime in a state of defenselessness. This analysis is carried out from a theoretical and practical study. First, a doctrinal study of the Due Process is carried out, its principles and especially the right to present a defense as a basic pillar inexorably linked to it. Then, an analysis of the mentioned right is carried out, both in the Cuban Constitution and in the Penal Procedure Law, beginning from a critical study of these norms. In the end, the conclusions emerging from the present article are presented.
