Resulta preocupante en el escenario actual la creciente situación de padres con patria potestad sobre sus menores hijos que sin dejar de cumplir a plenitud con los deberes y obligaciones para con los mismos, se ven imposibilitados de poder representarlos en toda la extensión que implica esta institución, debido a que no se encuentran en el territorio nacional o encontrándose dentro de este, en ellos concurra alguna causa que impida representarlos y los menores queden a cargo de algún familiar, vecino, e incluso otra persona que suple físicamente la figura de sus progenitores, cumpliendo materialmente con facultades y obligaciones que no gozan de respaldo alguno en el ámbito jurídico, razón por la cual se evidencia la necesidad de ensanchar la figura de la representación legal a través de la creación de una institución que se equipare a la patria potestad, previa autorización de los padres o del Tribunal competente, mediante un proceso de jurisdicción voluntaria. Para llevar a cabo la presente investigación se tuvieron en cuenta los criterios doctrinales y jurisprudenciales más avanzados, así como el derecho foráneo. En función de ello se utilizaron métodos del nivel teórico y del nivel empírico que permitieron respaldar la necesidad de la propuesta.
It is worrisome in the current scenario the growing situation of parents with parental authority over their minor children who, fully fulfilling their duties and obligations to them, are unable to represent them to the full extent of this institution, because it is not found in the national territory or being within it, there is some cause that prevents them from representing them and the minors are left in charge of a family member,neighbor,and even another person who physically supplies the figure of their parents,fulfilling materially with faculties and obligations that do not enjoy any support in the legal field, which is why it is evident the need to widen the figure of legal representation through the creation of an institution that is equated to parental authority ,with the prior authorization of the parents or the competent Court, through a process of voluntary jurisdiction. In order to carry out the present investigation, the most advanced doctrinal and jurisprudential criteria were taken into account, as well as the foreign law. Based on this, methods of the theoretical level and the empirical level were used to support the need for the proposal.
